On the 22nd June, 2019 a cyclist was riding his bicycle along the A4061, Bwlch Road into Tonypandy when a Suzuki GSXR 750 Motorcycle passed the cyclist closely. The motorcycle was clearly travelling at high speed and the driver was also acting irresponsibly. This dangerous incident was captured on a camera that was attached to the bicycle and was subsequently submitted to Operation SNAP.
Every submission to Operation SNAP by a member of the public is examined and investigated by one of our dedicated decision makers. The officer who reviewed this submission decided that the manner of driving fell far below what is expected from a careful and competent rider and decided to prosecute the motorcyclist.
The registered keeper of the motorcycle was Mr. Daniel Allegretto from Ogmore Vale to whom we sent out a Notice of Intended Prosecution (NIP). Mr. Allegretto returned the documents, naming an individual from the Merthyr area as being the rider at the time of the offence.
A NIP was issued to the nominated person who subsequently denied being the rider, and in fact stated that they were out of the country on a family holiday at the time of the offence.
The Central Ticket Office (CTO) relayed this information to Mr. Allegretto, who in return produced falsified documentation, stating that he had sold the motorcycle on the morning prior to the offence.
Following Mr. Allegretto’s denial that he was the rider, Sergeant 3325 Pearce, an Enquiry Officer for GoSafe who run Operation SNAP, proceeded to open an investigation into the circumstances surrounding the offence, and subsequent offence of Perverting the Course of Justice.
A protracted investigation identified evidence that the Motorcycle was not sold at the time stated by Allegretto, and was in fact being ridden by him.
The matter proceeded to trial at Cardiff crown court in March 2021 and on the 12th March the Jury found Mr. Allegretto unanimously guilty of Perverting the Course of Justice.
He was subsequently sentenced to six months imprisonment and handed a fine of £1,100.
Teresa Ciano, GoSafe Partnership Manager said:
“The excellent work demonstrated by Sergeant Pearce shows the real consequence for people who go to great lengths to avoid having motoring offences registered in their names.
The sentence reflects the seriousness of the offence and highlights the risk in the attitude of the offender towards careless and dangerous driving, which is a factor in serious and fatal collisions on our roads.
In GoSafe, we have a dedicated team of 10 enquiry officers and a number of support staff across Wales who are determined to investigate these cases and bring offenders to justice.“

Specialist Operations Chief Inspector Helen Coulthard said:
“I hope this conviction sends out a clear message to motorists, and also provides some reassurance to vulnerable roads users such as cyclists and horse riders.
All road users must act in accordance with road traffic laws at all time.
I would actively encourage members of the public to submit video footage to the Operation Snap team via the online facility, should they see motorists failing to heed this advice and committing offences or acting in a manner which endangers others. As this case demonstrates, such reports will be thoroughly investigated.”
You would hunt him down and fuck his life too, this just makes you hate cyclists more than ever

Clearly travelling at high speed...did the knob on the cycle have a speed camera as well,Bike may have sounded like it was shifting if it was revving, he is out near the white line so not that close...unless the cycle knob was using all the lane (as they like to do),road was straight no oncoming traffic and it looks like new asphalt and dry as a chip...

If this is used to prosecute someone then the guy that took the photo should be in court to verify it was his picture and his name should be released,Maybe not so quick to drop someone in it then...feckin ass hole.
The suzuki owner should have just fessed up and took his punishment.....then gone and hunted the bastard down.

Utter cunt. The only crime the bike was committing was having more fun than the cyclist. At it's pure root, thats the motivation. Clear road, no junctions, bit spirited riding perhaps but not dangerous

If that is the game the snide little shits are going to play, then I think its time pedal cyclists were made to have registration plates, as the amount of times I see them causing a hazard with their inconsiderate and sometimes unlawful riding is incredible, I capture it on my GoPro but you can't identify the tossers. Like this afternoon, when on a busy road a group of the twats were riding two abreast forcing cars to go around them well into the opposite lane, right in to my path 🤬

I discovered that the KOSO instruments fitted to ASBO kept a note of the fastest top speed achieved.
Apparently, some crazy b@stard had done 157mph 😳
I had to get my mates son to show me how to clear the speed log.
It comes to something when your own vehicle has the ability to grass on you! 🥴

The guy should have definitely owned up to it and I suspect that, if he had he might have got a few points if they even felt it was worth the prosecution given that the footage wasn't from an official calibrated camera. He was done for 'perverting the course of justice' rather than any road traffic offence. Of course they tout it as a victory for their shitty little scheme but the reality is that it was his lying about being the culprit that got him jailed and, I suspect he must have had previous even for that to have earned him six months. I notice it says nothing about him having been found guilty of driving recklessly or dangerously or having been handed any points or ban.

Self inflicted so zero sympathy here.
Only to a degree. Yes, he should have owned it once nicked but mate, that shouldn't have been a nick.

If anybody had a gun on me on my ride home tonight I'd be answering to multiple speeding infractions. At least this 'new initiative' means that if I overtake some dozy bastard at a pace I find comfortable unless I loft a wheel I'm kinda ok.

I still absolutely hate the mentality. It's akin to getting blocked when you're filtering.

I've stopped booting their doors in because I've grown up.

But he was DONE for lying not indeterminate speeding.
Thanks Rumpole. xx

Pulled for the wheelie though, that's what got him in the shit? I'm guessing they hooked on to the avoidance and 'PtCoJ' line as they're on thin ice maybe using third party, uncalibrated dashcam footage as the basis of a prosecution?

My specialism in Law is primarily avoidance rather than study so, straighten yer wig and tell us what we've to be wary of.

Please.

It is a difficult one because, if someone rammed us off our wheels and did a runner we would be grateful if someone's dashcam. helmet cam etc. meant the scrote responsible was caught and so, if someone reports someone else 'not in full control of their vehicle' as the plod would say we have to accept it if we want other video evidence to be admissible. He was committing an offence I believe as being on one wheel is not considered 'driving with due care and attention' and it would be hard to claim that the video evidence was unfair in any way as there is no question that that front wheel is not in connection with the ground.

The big booboo is that the guy hung himself by not copping to what was probably going to be treated as no more than a minor offence or possibly even just a 'ticking off'.

The world is full of sanctimonious arsehole cyclists that break the rules of the road every day ( i know what I'm talking about i witness it on rural roads like cat and fiddle and long hill ) without fear of prosecution...They are the first to complain at any minor infringement of other road user's whether it be intentional or a mistake/poor judgment...I can't stand cyclists...some decent ones I'm sure but as always its the bad ones we always remember...
